Are short-term rentals allowed in Eagle-Vail?

Verify the property. Eagle-Vail is unincorporated Eagle County, and the County decided in May 2025 not to adopt an STR ordinance, so there is no county license or cap. The EagleVail Metro District confirms that rentals of less than 30 days are subject to its 1% sales tax plus Colorado, Eagle County and RTA taxes and the county lodging tax. Whether a specific home, townhome or condo may be rented short-term depends on its HOA covenants, any deed restriction and the EagleVail Property Owners Association rules.

There are two levels of STR rules to check.

Short-term rentals allowed by the municipality does not necessarily mean short-term rentals are allowed at the property. Both levels have to say yes.

Set by the town, the county, or in Beaver Creek the Resort Company. They decide whether a license exists, what it costs, and which taxes apply.

  • Metro district 1% sales tax registration

In Eagle-Vail, level 2 usually looks like this

Eagle-Vail mixes single-family homes, duplexes, townhomes and condominium complexes, each under its own declaration, plus the community-wide EagleVail Property Owners Association covenants. Several condominium associations restrict or prohibit nightly rentals; several duplex and single-family filings do not address them. The answer for one side of a duplex can differ from the complex across the street.

Government level
Unincorporated Eagle County has no county STR license or registration. The Board of County Commissioners considered a county-wide ordinance and on May 13, 2025 decided not to adopt one; the County states that regulation is left to metro districts and HOAs. Source ↗
Taxes
EagleVail Metro District: "Short term rentals (periods of less than 30 days) are subject to the EagleVail sales tax (1%), as well as the Colorado, Eagle County, and RTA sales and lodging taxes. This includes rentals of residential property." All are state-collected. Colorado sales tax 2.9% + Eagle County sales tax 1.5% + Eagle Valley RTA 0.5%, plus the Eagle County lodging tax of 4% on stays under 30 days (2% since 2023, increased to 4% effective January 1, 2026), remitted quarterly on Colorado form DR 1485. Airbnb and Vrbo collect the state-administered taxes and the county lodging tax as marketplace facilitators. Source ↗
State license
Anyone renting accommodations for less than 30 days needs a Colorado sales tax license and files sales tax; marketplaces collect on bookings they process. Source ↗
Deed-restricted units
Eagle County's Affordable Housing Guidelines (Administrative Procedures, Aug. 1, 2023, §4.1.4) state that short-term leases are not permitted in price-capped or resident-occupied units, and the units may not be advertised on Airbnb, VRBO or similar sites. Source ↗
